These Terms and Conditions (“Terms”) govern all construction, engineering, and maintenance services provided by Reliable Engineering Solutions and its authorized DBA, Reliable Construction Solutions (collectively referred to herein as “we,” “us,” “our,” or the “Company”), to clients (“you” or “your”).
By requesting a quote, signing a proposal, or accepting our services, you agree to these Terms. In the event of a conflict between these Terms and a specific Home Improvement Contract (HIC) required by California law, the specific HIC shall control.
1.1. Service Definition
We provide construction, engineering, and maintenance services as specifically outlined in our written proposals. These services are performed under California State Contractor License regulations.
1.2. Change Orders (California B&P Code § 7159)
Any changes to the scope of work, contract price, or timeline must be agreed upon in a written Change Order, signed by both the Client and the Company prior to the commencement of any additional work. Extra work performed without a written agreement may not be billable.
2.1. Validity
Estimates are based on visible conditions. Prices are subject to change if actual project conditions differ materially from what was originally described or observed.
2.2. Exclusions
Unless explicitly stated, pricing does not include permit fees, inspection costs, or utility connection fees.
3.1. Residential Down Payments (B&P Code § 7159.5)
For Home Improvement Contracts (residential projects), the down payment will not exceed $1,000 or 10% of the contract price, whichever is less.
3.2. Commercial & Service Payment
For commercial projects or service calls not defined as “Home Improvement,” payment terms are outlined in your invoice or contract.
3.3. Progress Payments
If the contract provides for progress payments, the schedule of payments will be specifically defined in the contract and will correspond to the amount of work performed.
3.4. Late Payments
Late payments may incur interest charges as permitted by California law.
NOTICE TO OWNER:
Under California law, if we are not paid for the labor, services, equipment, or materials furnished to your project, we have the right to record a Mechanics Lien against your property. This right exists even if you have paid your general contractor in full, if the subcontractors or suppliers have not been paid.
5.1. Three-Day Right to Cancel
For Home Improvement Contracts negotiated at a place other than our permanent place of business (e.g., your home), you have a mandatory Three-Day Right to Cancel without penalty. If you cancel within this period, any deposit paid will be refunded in full within 10 days.
5.2. Standard Cancellation
For cancellations outside the statutory three-day period, or for commercial projects:
6.1. Delays
We make reasonable efforts to meet agreed-upon timelines. However, we are not liable for delays caused by circumstances outside our control, including but not limited to material shortages, weather conditions, or permitting delays.
6.2. Force Majeure
Events such as acts of God, fire, strikes, or governmental actions (Force Majeure) shall excuse the Company from strict performance of the schedule.
To ensure compliance and safety, you agree to:
8.1. Workmanship
We perform all work in a professional manner consistent with industry standards.
8.2. Residential Right to Repair (SB 800)
For residential new construction or substantial remodels, we adhere to the standards set forth in California Civil Code Title 7 (Requirements for Actions for Construction Defects).
8.3. Compliance
We perform all work in compliance with applicable California building codes, industry standards (NEC, IBC), and OSHA safety regulations.
9.1. Insurance
We carry Commercial General Liability (CGL) insurance and Workers’ Compensation insurance as required by the Contractors State License Board (CSLB).
9.2. Limitations
We are not responsible for pre-existing structural defects or damage caused by hidden site conditions not discoverable during a standard inspection6.
10.1. CSLB Arbitration
The Contractors State License Board (CSLB) provides an arbitration program for disputes regarding construction projects. Information about this program can be found at www.cslb.ca.gov.
10.2. Governing Law
Any legal action arising from these Terms shall be governed by the laws of the State of California.
